CIRCULAR

AMENDMENTS TO REGULATIONS ON ADMINISTRATIVE PROCEDURES IN\r\nTHE FIELD OF PLANT PROTECTION AND QUARANTINE

Pursuant to Decree No.\r\n15/2017/ND-CP dated February 17, 2017 of the Government on functions, duties,\r\nentitlements, and organizational structure of the Ministry of Agriculture and\r\nRural Development of Vietnam;

Pursuant to the Law on\r\nPlant Protection and Quarantine 2013;

Pursuant to the Law on\r\nForeign Trade Management dated June 12, 2017;

Pursuant to Decree No.\r\n69/2018/ND-CP dated May 15, 2018 of the Government of Vietnam elaborating on\r\nthe Law on Foreign Trade Management;

At the request of the\r\nDirector of the Plant Protection Department of Vietnam;

The Minister of\r\nAgriculture and Rural Development of Vietnam hereby promulgates the Circular on\r\namendments to regulations on administrative procedures in the field of plant\r\nprotection and quarantine.

1. Amendments to Point b\r\nClause 2 Article 21:

“b) Certified copies or copies\r\n(enclosed with the original for comparison) of establishment decisions or\r\ndecisions on functions and tasks of experimenting plant protection drugs;”

2. Annulment of Points b\r\nClause 2 Article 35.

3. Replacement of\r\nAppendix X promulgated with Circular No. 21/2015/TT- BNNPTNT with Appendix I\r\npromulgated with this Circular.

Article 2. Amendments\r\nto Circular No. 05/2015/TT- BNNPTNT dated February 12, 2015 of the Minister of\r\nAgriculture and Rural Development of Vietnam on the order and procedure for\r\nissuing Practicing Certificates of handling objects subject to plant quarantine\r\n(hereinafter referred to as “Circular No. 05/2015/TT-BNNPTNT”)

1. Annulment of Points g\r\nClause 1 Article 5.

2. Replacement of\r\nAppendix II promulgated with Circular No. 05/2015/TT- BNNPTNT with Appendix II\r\npromulgated with this Circular.

Article 3. Amendments\r\nto Circular No. 43/2018/TT- BNNPTNT dated December 28, 2018 of the Minister of\r\nAgriculture and Rural Development of Vietnam on several contents on import and\r\nexport of cultivars, livestock breeds, and plant genetic resources; import of\r\nplant protection drugs and import of objects in the List of objects subject to\r\nplant quarantine subject to pest risk analyses before their import to Vietnam\r\n(hereinafter referred to as “Circular No. 43/2018/TT-BNNPTNT”)

2. Annulment of the\r\nphrase “or certificates of business registration certificates or enterprise\r\nregistration certificates” in Points a, b, c, d, and dd Clause 1 Article 8;\r\nPoint c Clause 1 Article 9.

3. Replacement of Form\r\nNo. 01/BVTV and Form No. 04/BVTV of Appendix IV promulgated with Circular No.\r\n43/2018/TT-BNNPTNT with Appendix III and Appendix IV promulgated with this\r\nCircular.

Article 4.\r\nImplementation provision

1. This Circular comes\r\ninto force as of September 20, 2022.

2. Transitional provision\r\n

a) Regarding applications\r\nfor Decisions on the recognition of organizations eligible for experimenting\r\nwith plant protection drugs, Certificates of eligibility for trading plant\r\nprotection drugs submitted before this Circular comes into force, comply with Circular\r\nNo. 21/2015/TT-BNNPTNT;

b) Regarding applications\r\nfor Practicing Certificates of handling objects subject to plant quarantine\r\nsubmitted before this Circular comes into force, comply with Circular No.\r\n05/2015/TT-BNNPTNT;

c) Regarding applications\r\nfor Licenses to conduct imported plant quarantine regarding objects in the List\r\nof objects subject to plant quarantine subject to pest risk analyses before\r\ntheir import to Vietnam and Licenses to import plant protection drugs submitted\r\nbefore this Circular comes into force, comply with Circular No.\r\n43/2018/TT-BNNPTNT.

3. Difficulties that\r\narise during the implementation of this Circular shall be promptly reported to\r\nthe Ministry of Agriculture and Rural Development of Vietnam (via the Plant\r\nProtection Department) for consideration and settlement./.
